Terms of Service

Please read these Terms of Service carefully. These Terms govern your access to and use of the AI Business Optimization Assessment website, intake process, dashboard, reports, implementation guides, re-assessments, and related services provided through aibusinessoptimization.com.
By creating an account, purchasing an assessment, submitting intake information, using the dashboard, accessing a report, or otherwise using the service, you agree to these Terms. If you do not agree, do not use the service.
1. Who We Are and What the Service Provides
AI Business Optimization Assessment provides business-focused AI opportunity assessments for small and mid-sized businesses. The service may include account access, secure checkout, intake questions, AI-assisted or human-reviewed analysis, dashboard access, reports, implementation guides, recommended tools, quick wins, and follow-up or lifetime re-assessment features for the same business.
The service is designed to identify potential ways artificial intelligence, automation, software, workflow improvements, and operational changes may help a business save time, reduce manual work, improve follow-up, strengthen reporting, or uncover new growth opportunities.
2. Eligibility and Business Use
You must be at least 18 years old and able to form a binding contract to use the service. The service is intended for business and professional use, not consumer household use. If you use the service on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms.
3. Accounts and Security
You may need to create an account to purchase an assessment, complete intake, access reports, or request re-assessments. You agree to provide accurate account and business information, keep your login credentials secure, and notify us promptly if you believe your account has been accessed without authorization.
You are responsible for activity that occurs under your account, except to the extent caused by our failure to use reasonable security safeguards. We may suspend or restrict access if we believe an account is compromised, used fraudulently, or used in violation of these Terms.
4. Purchases, Payment, and Taxes
Purchases are processed through Stripe or another third-party payment processor. We do not store full payment card numbers on our servers. You agree to provide accurate billing information and authorize the payment processor to charge the amount shown at checkout, including any applicable taxes, fees, or charges disclosed during purchase.
Unless otherwise stated in writing, the assessment fee is charged per business being assessed. If your payment fails, is reversed, is disputed, or appears fraudulent, we may pause service delivery, dashboard access, report generation, or re-assessment access until the issue is resolved.
5. Refunds and Cancellations
Because the service involves custom intake, analysis, report generation, and business-specific recommendations, all purchases are generally final once work has begun. If you believe there was a billing error, duplicate charge, technical failure, or other exceptional issue, contact support promptly so we can review the situation.
Any refund, credit, or accommodation is discretionary unless required by law or specifically promised in writing. Refund requests may be denied where substantial custom work has already been performed, a report has been delivered, or the service has been used in a way that violates these Terms.
6. Intake Calls, Submitted Information, and Customer Responsibilities
To produce a useful assessment, you may be asked to submit information about your business, tools, processes, goals, customer workflows, employees, software stack, financial context, operational bottlenecks, and related topics. You represent that you have the right to provide this information and that the information you submit is accurate to the best of your knowledge.
You are responsible for reviewing your submissions before providing them. Do not submit information that you are not authorized to share, including another party's confidential information, regulated data, sensitive personal data, health records, payment card data, government identification numbers, passwords, private keys, or other high-risk secrets unless we have expressly agreed in writing to handle that type of information.
If the service includes intake calls or transcript review, you acknowledge that call audio, transcripts, notes, or summaries may be processed to provide the assessment. You are responsible for obtaining any consent required from participants you include on calls or in submitted materials.
7. AI-Assisted Analysis and Human Judgment
The service may use artificial intelligence systems, automation, third-party APIs, research tools, templates, and human review to generate assessments, summaries, recommendations, tool suggestions, implementation guides, and related outputs. AI-generated or AI-assisted outputs can be incomplete, inaccurate, outdated, or inappropriate for your specific situation.
You agree that reports and recommendations are informational business guidance only. They are not legal, tax, accounting, financial, investment, medical, employment, cybersecurity, or regulatory advice. You should consult qualified professionals before making decisions that require specialized advice or could materially affect your business, finances, legal obligations, employees, customers, or compliance posture.
8. No Guaranteed Results
We do not guarantee any specific revenue increase, cost reduction, productivity gain, profit improvement, customer growth, time savings, implementation success, software outcome, or return on investment. Any estimates, ranges, examples, projections, benchmarks, or opportunity scores are illustrative and depend on your business conditions, implementation quality, data quality, market conditions, vendor performance, staff adoption, and other factors outside our control.
You remain responsible for deciding whether and how to implement recommendations, selecting vendors, managing change, training staff, monitoring results, and complying with laws and contracts that apply to your business.
9. Lifetime Re-Assessments
If the website or checkout describes free lifetime re-assessments, that benefit applies to the same purchased business/workspace, subject to these Terms, continued availability of the service, reasonable-use limits, and any anti-abuse restrictions we may apply. Lifetime re-assessment access does not include unlimited custom consulting, implementation labor, software subscriptions, third-party fees, managed services, or assessments for unrelated businesses unless expressly stated.
We may modify, throttle, or restrict re-assessment access where usage is abusive, automated, fraudulent, technically harmful, outside the intended purpose, or imposes unreasonable operational burden. If the business materially changes ownership, legal identity, industry, or scope, we may require a new purchase for a new assessment workspace.
10. Reports, Recommendations, and Implementation Guides
Reports, implementation guides, quick wins, tool recommendations, workflow suggestions, and related materials are provided for your internal business planning and evaluation. You may use them inside your organization for the business that purchased the assessment. You may not resell, publish, sublicense, white-label, or represent the report as your own consulting product without written permission.
Recommended tools, vendors, integrations, websites, or third-party services may change availability, pricing, terms, security practices, features, or quality at any time. You are responsible for evaluating third-party tools before purchasing or deploying them.
11. Third-Party Services
The service may rely on or link to third-party services such as payment processors, AI model providers, analytics tools, email providers, telephony/intake providers, hosting providers, software marketplaces, and recommended business tools. Third-party services are governed by their own terms and privacy practices. We are not responsible for third-party outages, errors, pricing changes, security incidents, data practices, or vendor decisions.
12. Acceptable Use
You agree not to misuse the service, interfere with its operation, access data or accounts without authorization, reverse engineer protected parts of the service, submit unlawful, infringing, deceptive, or harmful content, or use the service for illegal, abusive, or high-risk activities. This includes malicious prompting, prompt injection, jailbreak attempts, attempts to reveal hidden prompts or secrets, attempts to bypass safety or scoring rules, and attempts to manipulate automated review or reporting systems. We may quarantine suspicious submissions for admin review and may suspend, terminate, or ban accounts for malicious prompting or related abuse.
You agree not to misuse the service. Prohibited conduct includes attempting to access another user's account or report, probing or attacking the website, bypassing authentication or rate limits, uploading malware, submitting unlawful or infringing content, scraping or reverse engineering the service, interfering with service operation, using the service to generate spam or deceptive content, or using outputs for illegal, discriminatory, or harmful purposes.
You also agree not to submit content that violates another party's rights, confidentiality obligations, privacy rights, employment obligations, intellectual property rights, or applicable law.
13. Intellectual Property
We and our licensors retain all rights in the website, software, templates, analysis methods, prompts, workflows, designs, branding, documentation, and service technology. Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable license to access and use your delivered report and related materials for internal business purposes.
You retain ownership of the business information, materials, and content you submit, subject to the rights you grant us to operate, provide, secure, improve, and support the service.
14. Privacy and Data Use
Our collection and use of information is described in our Privacy Policy. By using the service, you acknowledge that we may process account information, order information, intake responses, call or transcript information, dashboard activity, support communications, and technical logs as needed to provide, secure, troubleshoot, improve, and administer the service.
15. Confidentiality
We will use reasonable efforts to protect non-public business information you submit through the service. However, you should not submit trade secrets, highly sensitive regulated information, credentials, or mission-critical confidential data unless necessary and unless you understand the risks of processing that information through online services and third-party providers.
16. Availability, Changes, and Maintenance
We aim to keep the service available, but we do not guarantee uninterrupted or error-free operation. The service may be unavailable due to maintenance, upgrades, outages, network issues, security events, third-party provider failures, or circumstances beyond our control. We may update, modify, suspend, or discontinue features at any time, subject to applicable law and any specific commitments made in writing.
17. Disclaimers
To the maximum extent permitted by law, the service and all reports, recommendations, implementation guides, estimates, and outputs are provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise. We disclaim implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and course of dealing.
18. Limitation of Liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages; lost revenue; lost savings; business interruption; loss of goodwill; data loss; vendor failures; or costs of substitute services, even if advised of the possibility of such damages.
To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the service or these Terms will not exceed the amount you paid for the assessment giving rise to the claim during the three months before the event giving rise to liability, or one hundred dollars ($100), whichever is greater.
19. Indemnification
You agree to defend, indemnify, and hold harmless AI Business Optimization Assessment and its owners, operators, contractors, and service providers from claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, arising from your submitted content, your business decisions or implementations, your misuse of the service, your violation of these Terms, or your violation of law or third-party rights.
20. Termination
You may stop using the service at any time. We may suspend or terminate access if you violate these Terms, fail to pay, create security risk, misuse the service, or if continued service would create legal, operational, or reputational risk. Termination does not affect provisions that by their nature should survive, including payment obligations, intellectual property, disclaimers, limitations of liability, indemnity, and dispute provisions.
21. Governing Law and Disputes
These Terms are governed by the laws of the jurisdiction where the service operator is located, without regard to conflict-of-law rules, unless applicable law requires otherwise. Before filing a formal claim, you agree to contact us and attempt to resolve the issue informally. Nothing in these Terms prevents either party from seeking injunctive or equitable relief for unauthorized access, misuse, or intellectual-property violations.
22. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we may update the effective date, post the revised Terms, or provide additional notice where appropriate. Your continued use of the service after updated Terms are posted means you accept the updated Terms.
